Under the Education Act 2002, headteachers in England and Wales have the legal authority to exclude a pupil whose behaviour falls below the school’s expected standards.

However, exclusion should only ever be used as a measure of last resort. Schools must follow the statutory guidance issued by the Department for Education and the Welsh Government when making exclusion decisions. If the correct procedures are not followed, any subsequent appeal may be successful on the basis that the exclusion was procedurally unfair.

Where a pupil is suspended, the school must provide and mark suitable work for the first five school days of the suspension. If the exclusion extends beyond five school days, the school is legally required to arrange suitable full-time alternative education from the sixth school day onwards. Parents or carers should be informed of these arrangements and are responsible for ensuring their child attends.

During the first five school days of an exclusion, parents or carers must also ensure that their child is not present in a public place during normal school hours without reasonable justification. If an excluded pupil is found in a public place or returns to school during this period without permission, parents may face a fixed penalty notice or prosecution by the local authority.
